GENERAL TERMS AND CONDITIONS OF SALE

All orders imply acceptance of our general terms and conditions of sale, unless otherwise specified in special terms and conditions agreed by both parties

RTICLE 1: GROUP

A group is any entity of more than 12 people or any service calculated on the basis of a minimum of 12 people.
All group requests (for companies or individuals) are subject to a quote at our group rates, specifying the number of guests.

ARTICLE 2: RESERVATION GUARANTEE

All reservations must be:
Confirmed in writing and are validated by a deposit of 50% of the amount of the provisional quotation including VAT.
Accompanied by the quotation duly signed and marked “Good for agreement and firm confirmation”, or an order form signed by the order giver, stating
the exact billing address.
Any deposit paid will be forfeited in the event of cancellation by the client.
An option deadline and pricing details will be indicated on each quotation.
If no other information is provided, the quotation is valid for 30 days.
After this date, the company reserves the right to cancel the option without further notice.
In addition, only receipt of payment of the deposit will definitively confirm the option.

ARTICLE 3: PROCEDURE

Group menus are drawn up by the chef according to the season and are therefore subject to change.
The client must confirm the final number of people and the choice of menu. For reasons of service and client satisfaction, the chosen menu is identical for all guests.However, we do take into account any special diets that have been notified to us: allergies, beliefs, etc.
We must receive the said choice of menu and any additional information no later than 6 days before the event.
If the menu is not received by the Management by this deadline, we cannot guarantee provision of certain dishes on the menu.
On the day of the event, the group must arrive at the restaurant at the agreed time and with the agreed number of people.
In the event of late arrival, the restaurant reserves the right to keep the group waiting. If the delay exceeds 1 hour, the reservation will no longer be guaranteed.
In the event of a change in the number of people, the restaurant reserves the right to charge the number of people stated at the time of booking (see article 6: guaranteed number of covers).
As certain fresh products may be in short supply, the restaurant Management reserves the right to modify the dish with ingredients of equivalent quality. The Management undertakes to inform the client of any changes as soon as possible.

ARTICLE 4: PAYMENT TERMS

All invoices are payable:
Either by prepayment in full before the group’s arrival
Or on receipt of invoice and at the latest within 30 days of the invoice date.
After this date, the client will be liable for compensation for late payment calculated at the BANQUE DE FRANCE discount rate plus two points.

ARTICLE 5: INSURANCE

The establishment declines all responsibility for damage, loss or theft of any kind whatsoever of items
or materials brought by the client during their visit.
The organiser is liable for any direct or indirect damage that its guests may cause in connection with the event.

ARTICLE 6: NUMBER OF COVERS GUARANTEE

The number of covers must be confirmed in writing (letter, e-mail or fax) at least 72 hours before the date of the event.
Unless there is a specific agreement between the two parties, this number will be taken as the minimum basis for invoicing.
In the case of a privatised area, the number of covers must be confirmed 8 days before the date of the event. This will serve as the basis for invoicing
independently of any later changes.

ARTICLE 7: CONDITIONS AND PRICE CHANGES

The prices applicable on the date of booking are firm and definitive from the date of payment of the deposit.

ARTICLE 8: CANCELLATION

Cancellation:

  • between 8 and 5 days before the start of the event will be invoiced at 30% (or in the case of total privatisation of an area: 50% of the accepted quote)
  • less than 5 days to 72 hours before the scheduled date will be invoiced at 50%
  • less than 72 hours before the scheduled date will be invoiced at 100%, even for a partial cancellation.

ARTICLE 9: COMPLAINTS

Any dispute or claim will only be taken into consideration if it is made in writing and sent to the NATCO head office, Restaurant Le Petit Jardin, 20 rue Jean Jacques Rousseau, 34000 MONTPELLIER within a maximum of 8 days after the end of the event.

ARTICLE 10: FORCE MAJEURE

The service provider may not be held liable and no compensation may be claimed in the event of non-performance of its contractual obligations caused by a case of force majeure as defined by law.
